Overview of the F-1 Student Visa

  • Non-immigrant visa for full-time academic study at SEVP-certified institutions.

Optional Practical Training (OPT)

Employment Authorization Document (EAD)

STEM OPT Extension

  • Employer must be enrolled in E-Verify.

  • Staffing firms must document direct control and supervision.

Federal Oversight & HSI/ICE Investigations

  • HSI may perform random site visits.
  • Includes document inspection and supervisor interviews.
  • Must keep detailed training and employment records.
  • Non-compliance can result in loss of F-1 status and civil penalties.

Employment Status: Trainee vs. Productive Worker

  • STEM OPT work must be educational and training-based.
  • Training must be reflected in Form I-983 and actual duties.
  • The student must be supervised by qualified personnel.
  • Changes must be reported to DSO within 5 business days.

Transition from F-1 to H-1B Status

  • Specialty occupation visa requiring a bachelor’s degree or equivalent.
  • Employer must file Form I-129 during cap season.
  • Cap-gap rule allows extension of F-1 status until H-1B activation.
  • Allows dual intent and up to 6 years of employment in the U.S.
